A borrower with cash flow issues may be considering Chapter 11 bankruptcy and will typically need some form of debtor-in-possession (“DIP”) financing in order to fund operations during its bankruptcy case. However, a DIP Financing transaction presents important financial and legal challenges.

For lenders, it may be important to remain involved as a borrower goes through bankruptcy, and this means understanding how the bankruptcy process works, including DIP Financing and all that it entails.

For lawyers, required disclosures and remedial actions regarding possible lawyer-client conflicts are more extensive in bankruptcy than in other areas of the law, and so new legal counsel may be required.

This program provides an overview of the bankruptcy process, and focuses on DIP financing as well as recent trends and developments. Our panelists have valuable experience fulfilling different roles in bankruptcy proceedings, and will provide insight into how they fulfill their respective duties in order to help reach an optimal outcome.
