 Chapter 11 bankruptcies offer a powerful tool for reorganizing existing debt or maximizing the value of a distressed company.  However, the process is complex, time-consuming, and costly.  In some situations, secured lenders may benefit from the appointment of one or more independent directors, whose expertise and experience can steer the company away from a bankruptcy filing toward an alternative restructuring or sale transaction.  This panel—comprised of advisors, lenders, and independent directors—will explore the key issues that both secured lenders and independent directors should consider when choosing the best path forward.
