With the high costs of professional and administrative expenses, coupled with the inability of most middle market companies to qualify for the benefits of Subchapter V of the Bankruptcy Code, many financially distressed companies are unable to use the bankruptcy process to reorganize and/or sell their assets.
Our panel of experts will discuss, from the secured lender’s perspective, various non-bankruptcy alternatives to maximize restructuring and/or collateral monetization initiatives, including assignments for the benefit of creditors, secured party sales under Article 9 of the Uniform Commercial Code, state and federal court receiverships, and other out of court restructuring arrangements.
