New Insolvency and Secured Lending Laws
While there was a significant drop in insolvencies in 2021, there were dramatic changes to the insolvency laws in three key jurisdictions for secured finance in 2020 and 2021: for the new German restructuring regime, the “German Scheme” and the new “Dutch Scheme” in January 2021, and for the Corporate Insolvency and Governance Act 2020 in the UK in June 2020. Now it is 2022 and what has happened? What are these new rules of the insolvency road and how has it affected secured lenders?
